Maryland Lawmakers Move to Ban Cannabis Use in Vehicles With Children Present

Maryland lawmakers are weighing new legislation that would crack down on smoking, vaping, or using cannabis inside a vehicle when a minor is present. House Bill 544 aims to close a gap in state law by treating cannabis the same way Maryland already treats tobacco use around children in cars.

The bill would make it illegal to consume cannabis in the passenger area of a vehicle if a minor is inside — regardless of whether the car is moving or parked. Lawmakers designed the measure to protect children from secondhand smoke and vapor in enclosed spaces.

Under the proposal, violations would carry serious consequences. Anyone found guilty could face misdemeanor charges, punishable by up to one year in jail, a fine of up to $1,000, or both. The bill uses existing transportation definitions to clarify what qualifies as the passenger area, giving law enforcement clearer guidance when enforcing the law.

Supporters argue the legislation brings consistency to Maryland’s rules following cannabis legalization. State law already bans smoking tobacco in cars with children, but cannabis use currently falls outside those restrictions. Lawmakers backing the bill say that distinction no longer makes sense, especially as cannabis use becomes more common across the state.

The proposal is now under review by the Maryland House Judiciary Committee, where delegates will debate its impact, hear testimony, and consider potential amendments. If the bill clears committee and passes both chambers of the General Assembly, it would move to the governor’s desk for final approval.

Since Maryland legalized adult-use cannabis, lawmakers have continued to adjust regulations to balance legal access with public health and child safety. House Bill 544 reflects that ongoing effort, placing clear limits on where cannabis use is allowed when children are involved.
